By: Christine C. Ryan, Esq.

On February 9, 2016, Attorney General John Hoffman and the Office of the Insurance Fraud Prosecutor announced that North Jersey doctor Gautam Sehgal was indicted for billing insurance carriers for medical procedures that he did not perform. Dr. Seghal is charged by the State Grand Jury with seven counts of healthcare related insurance fraud and for submitting fraudulent bills to insurance companies.

According to the Indictment, Dr. Sehgal filed seven fraudulent health care claims, in which he purported to perform diagnostic needle Electromyography (EMGs) testing on seven patients. “In six of the cases an unlicensed technician, not Sehgal, performed the procedures. In the case of the seventh claim, no needle EMG was performed at all.”

Between July 2008 and October 2013, Dr. Seghal allegedly filed fraudulent claims to nine insurance carriers, including: 21st Century Insurance Company, Travelers Insurance Company, Encompass Insurance Company, Metropolitan Life Insurance Company, Allstate Insurance Company, Farmers Insurance Company, Progressive Insurance Company, AIG Insurance Company and NJ Cure Insurance Company.

Acting Insurance Fraud Prosecutor Iu stated, “[t]he allegations against Dr. Sehgal, if proven, show an utter lack respect for his patients, his profession, and the law.”
