DISTRICT COURT OF NEW JERSEY UPHOLDS ONE YEAR SUIT LIMITATION IN INSURANCE POLICY

The District Court of New Jersey recently decided a case upholding the one year suit limitation in Selective’s insurance policy. In Cholankeril v. Selective Ins. Co. of Am., the plaintiff was represented by a Florida attorney who received notice of the denial of plaintiff’s claim more than one year prior to filing suit. The court upheld the suit limitation on the policy and dismissed all claims.
